Is the Supreme Court a Judicial Conservative?
The only justice who was there at the time of Clinton v. Jones was Clarence Thomas, and that was a unanimous opinion anyway. There are no justices left from Fitzgerald. Do you see any basis on which to assess where the Supreme Court is likely to be on this subject? I'm not sure, but I think the most that you can say is that conservatives tend to be more solicitous of executive power claims than more liberal justices.
