The capture of the Santa Catarina, a Portuguese ship by a Dutch vessel is what became the sort of context in which Hugo Grocious wrote The Free Sea. He was retained by the Dutch East India Company to write a defense of this capture in a way that would justify Dutch actions. And that became the basis for his meditations on the idea of the freedom of the sea. It provided an understanding of how human beings relate to it and what possibilities there are for extending law over it.
