Catherine kemp is a senior lecturer in law at the university of new south wales. She's written on misuse of market power provisions and privacy issues. The biggest problem with the old prohibition was its excessive reliance on the take advantage test, she says. Now we're largely better off with this effect test, which is actually purpose effect or likely effect test. It will be harder for firms to raise pro competitive justifications some situations.
