In the US, due process is given to those who can afford it. In Bitcoin sphere, there are now plenty of people who can and will fight hard against these kinds of arbitrary rulings. The government does not want to fight this battle because it's much easier to leave Bitcoin in a sort of gray area than go for a full frontal attack on Bitcoins.
