The Non Delegation Doctrine in Public Health
Lawmakers historically have relied very heavily on broadly framed delegations of authority to public health officials. We have seen this doctrine rear its head an throughout the pandemic, and relatedly, the non delegation doctrine. If where we're headed is a situation where the courts y demand that congress or state legislature has to delegate authority in highly specific terms, that's bad for public health. And it's really important that we be very clear as to which justification we're using in any particular case.
