The History of Seizures

The Supreme Court has made pretty clear there are due process requirements to at least make sure that the assets in question are actually owned by a national of an enemy government or the enemy government itself. That's always been seen as the exception to takings clause requirements and due process requirements some extent. So raises just a lot of very novel questions that we haven't seen the courts wrestle with. The US government has never done it to my knowledge. They've never actually seized foreign government property outside of wartime.
